It is a good moved to vote on the separation of the office of ministry of justice from the office of Attorney General. But is that enough to deal with the political influenced omen our criminal justice system stinking over the fairness and justice our laws seek to achieve?. No, for the House to be fully commended and be celebrated as the liberators of our legal system from the influence of politics, here are the left over which need to be dealt with with immediate effect; Over time , in our legal system the two office were and still are controlled and headed by one person who is the minster of justice and as well as attorney general of the federation. Who is appointed by the government on power at that time. (The president appoint ministers, usually his political loyalists in his administration ). It should be that the office of Attorney General of the federation an independent office. Far from political affiliation and influence, Charged with the responsibilities of prosecutions of criminal cases brought before the court of law. And with all the powers of AG as entrenched in the constitution federal republic of Nigeria. He should be the the having the power of "nolle prosequie". To continue or discontinue any criminal trial. And his appointment to the office should be done by an independent judicial body like NJC without subjecting such appointment to the legislature. While the office of minister of justice should be purely political post. With all the political influence and discretion. Charged with the responsibilities of giving the government legal advice on the relationship between the executive and the legislative arm, guide the government on power of the executive, it limit, extent and their constitutional roles, duties and responsibilities. So as to avoid the recent constitutional power ignorance the executive patently displayed on the issues of most of their executive appointments. This office head should be the legal torchlight of the government and avoid interference with the duty of the attorney general. The minister of justice should appointed by the president, with the recommendation of the NJC and subject to confirmation of the Senate. With these, if followed strictly, our criminal justice system will have some sanity. And it will at least cover the distance pace the modern legal system kept off from ours.
